I found this article to be very interesting
and sad because it impacts so many good people. I've had dozens and
dozens of cases where my clients were wrongfully accused and arrested
but their charges were later dismissed or they were acquitted
after trial. Regardless, their mug shots still appear online. There
is currently no law in the State of Florida (and many other states) that
limits the unscrupulous behavior of these companies who post mug shots
not only of those presumed innocent but who have actually been found by a
judge or jury to be innocent. Instead, these companies extort "for a
fee" anyone with a mugshot to have it removed. Of course, as soon as it
is removed from one company, it pops up on another unscrupulous company
website. Even worse - and this is something only briefly mentioned in
the article - there are actually companies and even so called criminal
defense lawyers who offer "mug shot removal" services (for a fee of
course). Seems to me that the answer must be through legislature.
Unfortunately, I've learned not to expect much from our Florida
legislature.
